Na podstawie art. 13 ust. 1 i ust. 2 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) Kancelaria Prawnicza Maciej Panfil i Partnerzy Spółka Komandytowa informuje, iż:

Administratorem Pani/Pana danych osobowych udostępnionych w związku z wizytą i podjętą aktywnością na stronie internetowej www.panfil.pl, wysłaniem korespondencji elektronicznej na adresy z domeny panfil.pl i panfil.com.pl, wypełnieniem formularza kontaktowego na stronie www.panfil.pl, zawarciem i wykonaniem umowy z Administratorem lub zamiarem zawarcia umowy z Administratorem, jest Kancelaria Prawnicza Maciej Panfil i Partnerzy Spółka Komandytowa z siedzibą w Warszawie, Al. Jerozolimskie 123a, 02-017 Warszawa.

Zakres danych osobowych udostępnionych w związku z wizytą i podjętą aktywnością na stronie internetowej www.panfil.pl może obejmować m.in.: adres IP urządzenia, które połączyło się ze stroną, system operacyjny zainstalowany na urządzeniu, dane przeglądarki internetowej, aktywność na stronie oraz data i godzina aktywności.

W powyższym zakresie Pani/Pana dane osobowe będą przetwarzane na podstawie art. 6 ust. 1 lit. f Rozporządzenia – przetwarzanie jest niezbędne do celów wynikających z prawnie uzasadnionych interesów realizowanych przez administratora – uzyskania połączenia ze stroną internetową i dostępu do treści tam zawartych.

Dane osobowe w ten sposób udostępnione będą przetwarzane przez okres 3 miesięcy, o ile przepisy powszechnie obowiązującego prawa nie nakazują dłuższego przechowywania całości lub części tych danych.

Zakres danych osobowych udostępnionych w związku z wysłaniem korespondencji elektronicznej na jakikolwiek adres e-mail z domeny panfil.pl i panfil.com.pl może obejmować m.in.: imię, nazwisko, telefon kontaktowy, adres poczty elektronicznej, inne dane osobowe udostępnione w treści korespondencji.

W powyższym zakresie Pani/Pana dane osobowe będą przetwarzane na podstawie art. 6 ust. 1 lit. f Rozporządzenia – przetwarzanie jest niezbędne do celów wynikających z prawnie uzasadnionych interesów realizowanych przez administratora, w tym m.in. udzielenia odpowiedzi i ustalenia, dochodzenia lub obrony ewentualnych roszczeń, a jeśli korespondencja dotyczy nawiązania współpracy – także na podstawie art. 6 ust. 1 lit. b Rozporządzenia – przetwarzanie jest niezbędne do podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy.

Dane osobowe w ten sposób udostępnione będą przetwarzane przez okres niezbędny do udzielenia odpowiedzi, a jeśli korespondencja dotyczy nawiązania współpracy, do czasu zakończenia negocjacji, a następnie przez okres przedawnienia ewentualnych roszczeń, o ile przepisy powszechnie obowiązującego prawa nie nakazują dłuższego przechowywania całości lub części tych danych.

Zakres danych osobowych udostępnionych w związku z wypełnieniem formularza kontaktowego na stronie www.panfil.pl może obejmować m.in.: imię, nazwisko, telefon kontaktowy, adres poczty elektronicznej, inne dane osobowe udostępnione w treści korespondencji.

W powyższym zakresie Pani/Pana dane osobowe będą przetwarzane na podstawie art. 6 ust. 1 lit. a Rozporządzenia – na podstawie Pani/Pana zgody, a jeśli korespondencja dotyczy nawiązania współpracy – także na podstawie art. 6 ust. 1 lit. b Rozporządzenia – przetwarzanie jest niezbędne do podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy.

Dane osobowe w ten sposób udostępnione będą przetwarzane przez okres niezbędny do udzielenia odpowiedzi, a jeśli korespondencja dotyczy nawiązania współpracy, do czasu zakończenia negocjacji, a następnie przez okres przedawnienia ewentualnych roszczeń, o ile przepisy powszechnie obowiązującego prawa nie nakazują dłuższego przechowywania całości lub części tych danych.

Zakres danych osobowych udostępnionych w związku z zawarciem i wykonaniem umowy z Administratorem lub zamiarem zawarcia umowy z Administratorem może obejmować m. in. imię, nazwisko, telefon kontaktowy, adres poczty elektronicznej, inne dane osobowe udostępnione w trakcie współpracy. Dane pozyskujemy bezpośrednio od podmiotu danych, bądź od jego pracodawcy.

W powyższym zakresie Pani/Pana dane osobowe będą przetwarzane na podstawie art. 6 ust. 1 lit. b Rozporządzenia – w celu zawarcia i wykonania umowy, art. 6 ust. 1 lit. c Rozporządzenia – w celu wypełnienia nałożonych na Administratora obowiązków prawnych, art. 6 ust. 1 lit. f Rozporządzenia – w celu  realizacji prawnie uzasadnionego interesu Administratora, polegającego na zapewnieniu komunikacji niezbędnej do zawarcia i wykonania umowy oraz jej bieżącej obsługi, udzielaniu Państwu odpowiedzi na pytania, utrzymywaniu kontaktów biznesowych, jak również w celu ustalenia, dochodzenia lub obrony roszczeń.

Udzielenie danych osobowych jest dobrowolne, ale niezbędne do nawiązania współpracy i obsługi umowy. Odmowa udzielenia danych osobowych będzie skutkowała niemożliwością zawarcia i wykonania umowy, w tym udzielenia odpowiedzi na zadane przez Państwa pytania.

Dane osobowe w ten sposób udostępnione będą przetwarzane przez okres niezbędny do nawiązania i kontynuowania współpracy, jak również do przedstawienia ewentualnych ofert w przyszłości. Ze względu na to, że dane są niezbędne do celów wynikających z regulacji (w związku z obowiązkami podatkowymi) i do celów ustalenia, dochodzenia lub obrony roszczeń, dane mogą być również przechowywane do wygaśnięcia okresu przedawnienia dla obowiązków podatkowych związanych z umowami, który może zostać przedłużony o okres przedawnienia roszczeń cywilnoprawnych.

Pani/Pana dane osobowe nie będą ani przekazywane do państwa trzeciego lub organizacji międzynarodowej oraz nie będą udostępniane innym odbiorcom.

Posiada Pani/Pan prawo dostępu do treści swoich danych oraz prawo ich sprostowania, usunięcia, ograniczenia przetwarzania, prawo do cofnięcia zgody na przetwarzanie danych osobowych w dowolnym momencie, o ile przetwarzania odbywało się na podstawie zgody, bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem, prawo do wniesienia sprzeciwu wobec przetwarzania danych.

Posiada Pani/Pan prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych (adres: ul. Stawki 2, Warszawa), gdy w przypadku uznania, iż przetwarzanie danych osobowych Pani/Pana dotyczących narusza przepisy ogólnego Rozporządzenia o ochronie danych osobowych z dnia 27 kwietnia 2016 r.

Podanie przez Panią/Pana danych osobowych jest dobrowolne, jednakże niezbędne do udzielenia odpowiedzi na przesłaną korespondencję, o ile odpowiedź będzie konieczna. Konsekwencją niepodania danych osobowych będzie brak możliwości udzielenia odpowiedzi.

Pani/Pana dane osobowe nie będą przetwarzane w sposób zautomatyzowany, w tym również w formie profilowania.

Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), Kancelaria Prawnicza Maciej Panfil i Partnerzy Spółka Komandytowa informs that:

Personal data provided in this way will be processed for the period necessary to respond, and if the correspondence relates to the establishment of cooperation, until the conclusion of negotiations, and then for the period of limitation of possible claims, unless the provisions of generally applicable law prescribe longer storage of all or part of such data.

The scope of personal data provided in connection with filling out the contact form at www.panfil.pl may include, among others: name, surname, contact telephone, e-mail address, other personal data provided in the content of correspondence.

In the above scope, your personal data will be processed on the basis of Article 6(1)(a) of the Regulation – on the basis of your consent, and if the correspondence concerns the establishment of cooperation – also on the basis of Article 6(1)(b) of the Regulation – the processing is necessary to take action at the request of the data subject before concluding a contract.

Personal data provided in this way will be processed for the period necessary to respond, and if the correspondence relates to the establishment of cooperation, until the conclusion of negotiations, and then for the period of limitation of possible claims, unless generally applicable law prescribes longer storage of all or part of the data.

The scope of personal data provided in connection with the conclusion and performance of a contract with the administrator or the intention to conclude a contract with the administrator may include, but is not limited to, name, surname, contact telephone, e-mail address, other personal data provided in the course of cooperation. We obtain the data directly from the data subject or their employer.

In the above scope, your personal data will be processed on the basis of Article 6(1)(b) of the Regulation – for the purpose of concluding and performing the contract, Article 6(1)(c) of the Regulation – for the purpose of fulfilling the legal obligations imposed on the administrator, Article 6(1)(f) of the Regulation – for the purpose of implementing the administrator’s legitimate interest involving the provision of communication necessary for the conclusion and performance of the contract and its ongoing handling, answering your questions, maintaining business contacts, as well as for the purpose of establishing, asserting or defending claims.

The provision of personal data is voluntary, but necessary for the establishment of cooperation and the handling of the contract. Refusal to provide personal data will result in the inability to conclude and perform the contract, including answering your questions.

The personal data thus provided will be processed for the period necessary for the establishment and continuation of the cooperation, as well as for the presentation of possible future offers. Considering that the data is necessary for regulatory purposes (in connection with tax obligations) and for the establishment, assertion or defence of claims, the data may also be stored until the expiry of the limitation period for contractual tax obligations, which may be extended by the limitation period for civil law claims.

Your personal data will neither be transferred to a third country or an international organization nor shared with other recipients.

You have the right to access the content of your data and the right to rectify, erase, limit processing, the right to withdraw consent to the processing of personal data at any time, provided that the processing was carried out on the basis of consent, without affecting the legality of processing carried out on the basis of consent before its withdrawal, the right to object to the processing of data.

You have the right to lodge a complaint with the President of the Office for Personal Data Protection (address: 2 Stawki Street, Warsaw), if you consider that the processing of personal data concerning you violates the provisions of the General Data Protection Regulation of April 27, 2016.

Your provision of personal data is voluntary, however, it is necessary to respond to the correspondence sent to you, if a response is necessary. The consequence of failing to provide personal data will be the inability to respond.
